Employment & Labour Law in Malta and Cyprus

Both the Maltese and Cypriot Constitutions consider the right to work as an individual’s fundamental human right. They go over and beyond the mere right to work and promote proper working conditions that make the right to work an effective one. The Maltese Constitution actually lists the right of citizens to work as a fundumental right and it also delineates the state’s role in promoting the conditions to make this right effective.

In Malta, employment is regulated rigorously on a local level. Maltese employment & labour law can be found in the Employment and Industrial Relations Act (EIRA), Chapter 452 of the laws of Malta. Moreover, throughout the years we have seen a number of specific regulations being enacted to address private and public safety, minimum safety standards at work, wage expectations and applicable overtime work rates, the allocation and consumption of working hours by employer and employee, the paid and unpaid leave entitlements and others matters. In addition, the decisions of a number of local courts and tribunals and a number of industry-specific collective agreements may apply as regulations for the employment industry in Malta.

Ancillary matters which relate to employment, such as work permits, licence to operate as an employer, the payment of wages and deductions of income tax and other fiscal considerations, business permits and so on are also specifically addressed.

In Cyprus, one can also find a  plethora of legislative measures that regulate the employment & labour law sector. Cyprus holds membership with the International Labour Organisation and is a signatory to the European social charter.
